TINY HOME SIZE REQUIREMENTS IN FLORIDA

 

In Florida, a tiny house is a livable structure with a floor area of 400 square feet or less, excluding lofts. While Florida's building code regulations are based on the 2018 International Residential Code, each county has specific regulations that residents must adhere to. The two types of tiny homes that fall under different regulations are Tiny homes on wheels and foundations.

1. Tiny Homes on Wheels (THOW)

These fall under R.V. regulations and can be parked in mobile home parks and R.V. parks. Counties and cities prohibit residents from using THOW as permanent residencies, although some R.V. and mobile home parks may provide an exception. THOWs have to be the only primary residential structure on a lot. Specific counties have unique regulations on parking THOWs, so it's always important to contact local authorities for clarification. For example, if a THOW spends more than 45 days in an R.V. park in Sarasota County, it must be on a foundation.

Minimum Requirements:

Florida does not have a minimum size for THOWS; however, recreational vehicle (R.V.) spaces must be at least 1,200 square feet and have a density of no more than 25 units per acre.

Maximum Requirements:

  • Length: The combined length of two vehicles, including bumpers, cannot exceed 65 feet. Motorhomes can be a maximum of 45 feet long, while trailers are 40 feet long.
  • Height: The maximum height for tiny homes and R.V.s in Florida is 13.5 feet.
  • Width: The maximum width is 8 feet 6 inches, past which a permit is necessary.

To ensure safety, R.V. length limits in state parks may vary, with some parks having a 40-foot limit and others up to 50 feet.

2. Tiny Homes on Foundations

The Florida Building Code has several dimensional requirements for tiny houses. The ceiling height for habitable spaces and hallways in tiny houses should be no less than 6 feet 8 inches or 2032 mm. The ceiling height must be no less than 6 feet 4 inches or 1930 mm for bathrooms, toilet rooms, and kitchens. Obstructions like beams, girders, ducts, and lighting should not exceed these minimum ceiling heights. In lofts, ceiling heights can legally be under 6 feet 8 inches or 2032 mm. Lofts should have a minimum floor area of 35 square feet and measure at least 5 feet or 1524 mm in any horizontal dimension.

The requirements for a structure to qualify as a residential building vary by county. Some examples include

  • Pasco County and Dixie County: a minimum floor area of 450 square feet
  • Pinellas County: a minimum floor area of 150 square feet
  • Orange County: a minimum floor area of 400 square feet

 

 

What Are the Tiny Home Regulations in Florida?

In Florida, the regulations on tiny homes can be a grey area, which can be difficult for individuals to navigate. In order to ensure standardization and safeguard Florida's claim in accommodating tiny homes, there are various regulations by which all tiny homeowners must abide. They include;

  • Building Codes: Tiny homes must be structurally sound, and all systems must be safely and correctly installed. For THOW, their plumbing, heating, and electrical work have to meet the standards set by the National Standards Institute. THOWs exceeding 400 square feet must hold a United States Department of Housing and Urban Development label and satisfy Federal Manufactured Home Construction and Safety Standards. 
  • Parking Requirements: The two primary options for legally parking tiny homes in Florida are Tiny House communities and Resorts or R.V. parks. The size requirements differ between counties and state parks.
  • Insurance Requirements: In Florida, you require insurance for towing, parking, and constructing tiny homes. Specialty insurance companies insure tiny homes either as R.V.s or manufactured homes. You must select the right insurer; some require a separate policy for personal contents in tiny homes.
  • Fire Safety: Tiny homes must have fire safety equipment like extinguishers, sprinklers, and detectors and comply with Section R310's emergency escape and rescue openings requirements.
  • Property Tax: Since Florida considers most tiny homes mobile homes or RVs, they are exempt from most real estate taxes but are subject to personal property tax as vehicles. However, a tiny home on a fixed foundation will likely be taxed as real property.
  • Zoning Laws: Zoning laws dictate how land can be used in Florida and can vary to specific municipalities. They cover the Minimum and maximum size of dwellings, their maximum height, and setback requirements from property lines. Always engage local zoning officials to help navigate the various laws to avoid fines.
  • Utility Connections: In Florida, both THOW and Tiny homes on foundations must connect to the local utilities.
