TINY HOME SIZE REQUIREMENTS IN CALIFORNIA

1. Tiny Homes on Wheels (THOW)

These are classified as RVs or movable tiny houses and must adhere to the ANSI or NFPA  standards and HCD regulations. 

Minimum Requirements:

  • Tiny houses on wheels have no minimum size requirement. However, the ANSI A 119.5 requirement for Park Model RVs suggests that the living space should be at least 70 square feet.

Maximum Requirements:

  • Length: A maximum of 40 feet without requiring a special permit.
  • Width: A maximum of 8.5 feet without a special transport permit. A tiny house of this size can be towed on public roads without requiring an oversized vehicle permit.
  • Height: A maximum of 13.5 feet from the ground to the top of the roof.

2. Tiny Homes on Wheels (THOW)

Tiny houses on foundations are considered ADUs (accessory dwelling units) or primary residences in California. They must adhere to the CRC (California Residential Code), which is based on the IRC with state-specific modifications.

Minimum Requirements:

  • Living Area: The California Residential Code (CRC) specifies a minimum home size:
  • The minimum size for a livable room should be 70 square feet.
  • At least one room in the home (usually the living room or combination living/sleeping room) must be a minimum of 120 square feet.
  • The ceiling height should be 7 feet in habitable spaces (excluding loft areas).

Maximum Requirements:

  • The state level has no maximum size requirements for tiny houses built on foundations. However, the local jurisdictions might have their own zoning codes specifying the maximum size of a tiny house on a foundation. Do your research before building)
  • California law limits the size of tiny homes on foundations to 1,200 square feet or less. However, local jurisdictions might set smaller limits between 600 and 1000 square feet.

  • Parking Requirements: THOWs must be parked in areas like RV parks or private land where local ordinances permit. Local regulations may prohibit or restrict parking on streets or in driveways.
  • Utility Connections: Tiny homes on foundations must connect to local utilities (sewer, water, electricity) and adhere to the applicable codes. However, those on wheels may not need to be connected to utilities if designed for off-grid living. Many jurisdictions require any type of tiny home to be connected to some form of utility.
  • Fire Safety: Tiny homes must meet fire safety standards. That involves fire extinguishers, smoke alarms, and fire sprinklers if necessary.
  • Sanitation: Adequate sanitation facilities must be used. Compost toilets, greywater systems, and similar solutions might be used for those on wheels but must comply with local health department regulations.
