TINY HOME SIZE REQUIREMENTS IN COLORADO

Like many other states, Colorado has yet to establish concrete statewide regulations on tiny homes. In Colorado, tiny homes can be set on foundations or constructed permanently on a vehicle chassis but cannot be self-propelled. Those on a vehicle chassis are known as Tiny Homes on Wheels (THOW). Tiny size home requirements vary by county and municipality, but effective July 1, 2023, a tiny home in Colorado is a residential structure of 400 square feet or less. It has to be designed for long-term residency and have a metal plate insignia installed under the kitchen sink by the Division of Housing. However, always take your time to research the regulations in the specific area where you are looking to park or erect a tiny home.

1. Tiny Homes on Wheels (THOW)

The benefits of this type of tiny home are their mobility and the fact that you do not have to be a landowner. In most Colorado counties, THOWs are deemed recreational vehicles or RVs, and living in one all year round is prohibited. You legally cannot camp a mobile home or RV in the same place for more than two weeks per year. Owners of THOWs must obtain certification from RVIA and adhere to the American National Safety Institute standards 119.2.

Minimum Requirements

There are no minimum size requirements for THOWs in Colorado. However, in 2016, the Colorado Legislative Council Staff issued a directive on tiny homes stating that "all tiny homes must comply with any applicable local zoning code ordinances," which sometimes place additional requirements on minimum square footage.

Maximum Requirements

These requirements mainly apply during the shipment of tiny homes rather than in their destination municipalities.

  • Length: Maximum trailer length 40 ft. The maximum combined length of two vehicles is 65 ft.
  • Width: Maximum width is 8.5 feet
  • Height: Maximum RV height 13.5 ft.

2. Tiny Homes on Foundations

House Bill 22-1242, actualized on July 1, 2023, allowed Colorado factory-built homes of about 400 square feet or less to become permanent housing units. Since then, some counties, like Larimer County, have begun allowing residents to reside in their tiny homes for more than 180 days. 

3. Transitional Structures

These structures lie between temporary and permanent tiny homes. They are tiny homes on foundations that can be disassembled and shipped on the back of a trailer. Since only a little information is available on their legal position, they lie in a grey area of the law. It is best to consult with local municipal building officials.

What Are the Tiny Home Regulations in Colorado?

Colorado law regulates manufacturers, sellers, and installers of manufactured homes, including tiny homes. The state housing board sets standards for the proper manufacture and installation of manufactured homes. However, local county and municipal laws may have additional regulations.

  • Fire Protection Systems: Tiny homes must have automatic fire sprinkler systems as required by the local jurisdictions where the structure will be set. A certified inspector must approve the system. Other requirements may include smoke alarms, carbon monoxide alarms, and regulation-size window openings.
  • Ice barriers:  Colorado has a history of ice forming along the eaves, so an ice barrier is required.
  • Fireplaces:  Every fire must comply with the IRC guidelines on fireplaces
  • Property Tax: Since Auxiliary dwellings and RVs do not adhere to the standards of a conventional house, they are not subject to property tax, which makes a tiny house even more accessible. Tiny homes are, however, subject to motor vehicle taxes, depending on where you live.
  • Insurance: If your tiny home on wheels is RVIA certified, you must seek an RV policy that meets your needs. If your tiny house is fully paid for, you are not required by any government agency or private company to maintain an insurance policy. However, having one in the event of total loss is advisable.
  • Parking Requirements: In Colorado, tiny homes must park on a single lot or at a recreational vehicle park. When in an RV park, they must comply with ANSI RVIA standards.
  • Utility Connections: Tiny homes must comply with state regulations when connecting to local permanent utility connections, such as electrical and plumbing.
  • Zoning Laws: These dictate the use of land in specific municipalities. The best way to ensure adherence is to contact local zoning offices.
