TINY HOME SIZE REQUIREMENTS IN OREGON

For a residential structure to qualify as a tiny home in Oregon, it has to be  400 square feet or less. Tiny homes fall into two categories: Tiny Homes on Wheels (THOW) and Accessory Dwelling Units. Despite the tiny "houses" name, these structures can have many uses, not just as residential. Different codes and standards apply to various uses of tiny homes. For example, a THOW utilized for an office or art studio might be acceptable as an accessory in a residential zone. In contrast, a THOW used as an accessory dwelling, such as a rental unit, is unacceptable in some cases. These rules and regulations vary by county and city, with some areas requiring minimum square footage and a specific distance from existing structures. In contrast, others restrict where tiny houses can be parked. Conduct your due diligence before purchasing or building a tiny home in Oregon to avoid violating the law.

1. Tiny Homes on Wheels (THOW)

These are classified as temporary dwellings and defined as any tiny house attached to a frame or chassis, with or without wheels. They can only be used as permanent residences or attached to the ground if in a mobile home park. They can be used as a residential if lawfully connected to water and electrical supplies and a sewage disposal system.  Since January 1, 2020, the State Building Code no longer regulates the construction of these temporary dwellings, with that jurisdiction being passed to local municipalities. Tiny homes on wheels designed to move on public rules fall under the Federal Motor Vehicle Safety Standards. The National Highway Traffic Safety Administration (NHTSA) has adopted these standards, which regulate brakes, lights, wheels, tires, rear impact guards, and VINs.

Minimum Requirements

Since these qualify as R.V.s when on public roads, they have no minimum size requirements. However, some counties have minimum square footage requirements when these structures are used as dwellings.

Maximum Requirements

The regulations are split between THOWs designed for regular highway movement and those not. In Oregon, mobile tiny homes cannot legally be wider than eight and a half feet. The legal trailer dimensions for highways in the state are:

  • A total length of 60 feet.
  • A trailer length of 40 feet.
  • A width of 102 inches.
  • A total height of 14 feet.

2. Tiny Homes on Foundations

Also known as Accessory Dwelling Units, these are tiny houses attached to a proper and approved foundation. The regulations governing them are more established than those of THOW. They are limited to a maximum of 400 square feet and must be built according to the 2018 International Residential Code ((IRC) guidelines adopted by Oregon for tiny homes. Oregon allows tiny homes to have one sleeping loft with a ladder as the primary means of access.

3. Transitional Structures

These are dwellings on foundations that can be deconstructed and moved. Local governments are tasked with the establishment and regulation of these units.

What Are the Tiny Home Regulations in Oregon?

Tiny home regulations are put in place to ensure the safety of occupants as they pose similar dangers as conventional houses. Oregon has been a front-runner in championing the relaxation of the regulations on tiny homes nationwide to counter homelessness. By June 2022, cities in the Portland area or those with populations over 10,000 were allowed duplexes in areas zoned for single-family tiny homes.   • Zoning Regulations: Oregon's local governments adopt zoning maps and development standards that control land use through land use regulations, usually codified in a "development code" or "zoning ordinance."
  • Fire safety: Tiny homes with sleeping lofts used for residential purposes in Oregon must have an automatic fire sprinkler system. Other recommended fire safety equipment includes carbon monoxide detectors, smoke detectors, and fire extinguishers.
  • Construction Regulations: Manufacturers are required to use plumbers and electricians licensed in the state to conduct installations and repairs. The builders of tiny homes constructed on-site must also be certified by the state.
  • Building Code: To legally erect a permanent tiny home in Oregon, you should adhere to the federal standards or the Oregon building code. Two principal codes apply in the state: The Oregon Residential Specialty Code and the Oregon Small Home Specialty Code.
  • Utility Connections: A tiny home must be connected to permanent electrical and water supplies and a sewage disposal system for it to be used as a permanent residence.
  • Insurance: If your tiny house is not under any credit, no government agency requires you to have an insurance policy. THOWs may, however, require motor vehicle insurance.
